You hereby confirm and acknowledge that by clicking on the box indicating your acceptance to the Terms & Conditions of TheTourExchange.com/las-vegas/ website (herein “Exchange”), you agree to be legally bound by all terms contained herein and you use the site at your own risk. The Exchange may at any time modify terms & conditions of the site. Any usage of the site will be conditioned upon the terms in force at the time of such use.
Authorized Access
The condition of use governs your use and access to the Exchange. You may not use or download content from the Exchange for any other commercial purpose without written permission from the Exchange.
Bid, LLC (dba TheTourExchange.com, herein referred to as the “Exchange”), a Nevada Limited Liability company, maintains the Exchange and Provider Exchange including all information, data, software, photographs, logos, graphics, videos, typefaces, music, sounds, images, illustrations, designs, icons, and any other materials (collectively “Content”). All Content in and on the site is for informational purposes only for information on tours, attractions, shows and any other product(s) (collectively “Activity”) sold on the Exchange.
Privacy Policy
Your privacy is important to the Exchange. Your name, email address, street address and telephone numbers are stored in our database for user log-in and customer history purposes only. Exchange will not sell, rent, trade, or give your payment or personal information to any other organization; however, the Exchange reserves the right to release information to the appropriate authorities if we believe that such release is reasonably necessary to comply with the law or to protect the property and/or safety of Exchange or any of its affiliated companies, employees, users or others. Future changes to our privacy policy will be posted in advance on this page. If you prefer not to receive email or postal mail from us, telephone us at 844-868-7392, or 702-379-5422, and we will gladly honor your request.
Additionally, the Exchange collects certain data points including IP addresses, browser and device type for statistical purposes. This data will be evaluated in order to improve the overall use and performance of the site.
Conditions of Use
You agree that you will not engage or assist others in the following:
- Using the Exchange to transmit or engage in any form of distribution of spam, junk email, contests, pop-up ads, cookies, pornography or illegal content.
- Use robots, spiders or malicious spyware or other devices to index the site of its content.
- Transmit computer worms, bugs, defects, Trojan horses or any other viruses that would interfere with the functionality of the site or its user’s computer equipment or mobile devices.
- Retrieve any data from the site including images, trademarks, product content or any data relevant to the Provider.
- Attempt to gain unauthorized access to the site.
- Post reviews on any Activity in which you have not participated.
- Promote discrimination in any form.
Registration
You further acknowledge that upon registering a user account on the Exchange you are providing personal data including your name, address, phone number and email address. We will also store information regarding the products you have purchased. Part of your information will be transmitted immediately to the applicable Provider for the purposes of processing your booking. You agree the Exchange reserves the right to pass on relevant information to third parties, authorities, and so on, if it is necessary to respond to claims and demands of all kinds.
Booking Request
The Exchange provides you with an online booking platform for Activities. The Exchange is not a contractual partner for the booked product(s), the Exchange acts solely as the intermediary between the User and the Provider. Prices are set by the individual Provider. Due to the high demand and popularity of any Activity featured on the Exchange, purchases are not an immediate confirmed reservation, they are a request. When you purchase an Activity for either same day or next day use, you may contact our friendly Travel Concierge at 844-868-7392 to confirm your redemption instructions and/or pick-up details. For guests with advance reservations of 48 hours or more, please allow a minimum of 24 hours from purchase for the Provider to respond and confirm your booking. The Exchange gives no guarantee on the performance of a Provider in relation to their response; however, in the event a Provider is not able to accommodate your booking request, the Exchange reserves the right to move your request to another Provider offering the same service. If your requested service is not available, the Exchange will contact you with the option to move your Activity to an alternate date or upgrade to an alternate Activity which may or may not be of the same retail rate. User understands they are responsible for paying any increase in rates when being upgraded to an alternate Activity, if applicable. If we are not able to secure your request with any Provider, the Exchange will notify you and process a refund in full.
Price Match Guarantee

The Exchange values your time and your budget therefore, instead of spending your free time researching hundreds of sites, we have done all of the leg work for you. This allows you to save both time and money, finding the right Activity at the right price. Shop with confidence and piece of mind because w
hen you see our Price Match Guarantee logo on an Activity, you’re receiving an exclusive price you cannot find lower, anywhere else. Our rates are also all-inclusive, there are no extra fees at checkout.
Your purchase of an Activity from the Exchange, with the Price Match Guarantee logo, is protected with a money back guarantee. If you do find a lower advertised rate, with all applicable fees, for the same Activity on the same date and time with the same Provider, the Exchange will refund you the difference between your purchase price and the advertised rate. (Not applicable for Activities on the Exchange that may have a price change after initial your initial purchase).

Payment
When you pay for your Activity, your credit card will be processed by Stripe. Payment will show on your credit card statement as Bid, LLC and the applicable Activity Provider. Bid, LLC, does not store credit card data and works with PCI compliant third party credit card processors. Payment in full is required at the time of making your booking. The Exchange accepts the following credit cards: Mastercard, American Express, Visa and Discover.
Change & Cancellation Policy
Changes must be made with a minimum of 7 days notice prior to the date of the activity and are subject to availability of the activity. Customers are responsible for any price difference and/or change fees, if applicable.
Cancellations made at least 7 days prior to the date of the activity are fully refundable of the original retail price.
Cancellations made between 3-6 days prior to the date of the activity are eligible for a 50% refund.
Cancellations made within 0-3 days of the applicable activity are non-refundable, subject to 100% of the applicable retail price. No credit or refund will be given for no-shows or cancellations outside of the terms stated above.
The cancellation policy for the Exchange is enforceable regardless if no cancellation policy is documented on the Provider’s voucher/ticket. If you choose to make a credit card chargeback before the commencement of the applicable day/date of your Activity, the applicable Provider will consider your booking null and void. If weather conditions, governmental actions, unforeseeable or unavoidable external factors or circumstances prohibit the fulfillment of your Activity, the Provider may cancel without adherence to the aforementioned cancellation policy. This is done under exclusion of any compensation for damages or other legal claims.
After a reservation is made, no credit or refund is given for any changes in price. Credit will not be issued if you fail to cancel an itinerary within the specified time frame prior to the scheduled activity. Once a tour, show or activity has commenced, no credit or refund can be given except as directed or notified by the Provider to the Exchange. All refund requests must be directed to the applicable Provider.
The Tour Exchange reserves the right to cancel or modify reservations where it appears that a customer has engaged in fraudulent or inappropriate activity or under other circumstances where it appears that the reservations contain or resulted from a mistake or error.
User Conduct
The Provider has the right to refuse entrance, admittance or exclude you from participation in the event that you do not meet the Provider minimum requirements or your participation puts you or others at risk or otherwise interferes with the proper conduct of the Activity. In these occurrences, the amount you paid will be forfeited and non-refundable.
Cookies
Cookies are small text files that are placed on your computer that you visit or certain email you open. They are used in order to make the Exchange website work better, as well as to provide business & marketing information. The Exchange uses cookies on the site to achieve the following:
* Balance website traffic to ensure our users receive consistent and reliable service.
*Limit traffic to key parts of the website in order to maintain performance levels.
* Keep track of registered members when they are logged in. Track demographical, browser type, phone application for statistical marketing purposes.
* Gather feedback on user satisfaction through our website survey.
* Track how users use the site including bounce rate, and other useful data to improve the performance of the site.
* Display messages or pages which offer a section of products based on what you have previously purchased or indicated a level of interest.
The Exchange holds no responsibility for the performance or your computer browser.
Pricing
Prices are ALL-INCLUSIVE, per person and in U.S. Dollars unless otherwise stated. Prices are subject to change without notice. Unless otherwise stated, the price of listed experiences include fuel surcharges, taxes and fees. Prices do not include gratuities/tips, food and beverages, unless otherwise indicated in the listing. Exchange does not offer personal travel insurance coverage and in some instances, prices may not include departure or landing taxes or park entry fees. This information will be listed in the EXCLUSIONS section of the experience.
Fees
Applicable fees may be payable locally at the commencement of the applicable Activity. Any such associated fees may be listed in the product description (Exclusions).
Legal Disputes
These terms & conditions and any dispute arising out of it or related to it shall be governed, construed and interpreted in accordance with laws of Nevada and applicable United States federal laws, with regard to choice or conflicts of law rules. The courts of Clark County in the State of Nevada shall have exclusive jurisdiction over this Agreement.
Liability
The Exchange accepts no responsibility for any sickness, pilferage, labor disputes, machinery breakdown, government restraints, acts of war and/or terrorism, weather conditions, defect in any vehicle of transportation or for any misadventure or casualty or any other causes beyond our control. You agree the Exchange shall not be liable in the event of injury, damage, suffering, or loss of life in the event of any incident, accident occurring on a product you have purchased on the Exchange.
